What is a Society?

When a group of minimum 7 (Seven) individuals, who are not related to each other by blood relation, unite to accomplish common purpose, it is referred as Society. Society Registration Act, 1860 governs the Registration of Society. When a Society registers, it becomes legal entity. Additionally, it brings uniformity in the way of working of Societies which helps in better governance too. It is mostly formed to carry out activities like scientific/charitable or literary works. The purpose of Society Registration can be underlined as it enables to give boost to legal conditions of Society. It also helps Society to get a legal status in India. In other words, it becomes a legal entity.

Significance of Society Registration:

It is said that Society Registration helps in improving civic life of the people of the country. The imperative aspect for Society Registration is that minimum seven members or more can create Society.

Advantages enjoyed by Society after its Registration:

  • Society gains a status of a legal entity.

  • Society can sue and get sued.

  • Society can open and operate its Bank Account in any Bank.

  • Income Tax exemption can be availed by a Society if a registered Society gets registered under 12-A & 80-G of Income Tax Act.

  • In case of unlawful activities, the members are held to pay the debts as well as obligations.

  • In case of profit, if debts and obligations are incurred by members for the purpose of obtaining money, the members are liable to pay else members can’t be held liable.

 

Society also needs to bear certain limitations which are as follows:

  • Only 12-A & 80-G recognised Society can enjoy Tax exemptions provided they are considered to be engaged. in charitable activities according to Income tax department.

  • All the decisions will be taken by Majority.

  • Blood Relation is not allowed in a Society.

Documentary requirements for a Society Registration?

Requirements for Delhi Level Society Registration-​​

  • 2 (Two) sets of constitution (Memorandum of Association and Rules & Regulations).

  • Registered Office’s ownership proof i.e. Registered Property documents and Latest Electricity Bill.

  • Aadhar Card/Passport/Driving License/Voter ID of the minimum 7 (Seven) members of Society as an identity proof.

Requirements for All India Level Society Registration-​​

  • 2 (Two) sets of constitution (Memorandum of Association and Rules & Regulations).

  • Registered Office’s ownership proof i.e. Registered Property documents and Latest Electricity Bill.

  • Aadhar Card/Passport/Driving License/Voter ID of the minimum 7 (Seven) members of Society as an identity proof.

Society Registration in India!

In India; Society Registration Act, 1860 is a central Act though, every state has right to Amend it according to their ease e.g. in NCT of Delhi Society Registration process was offline till 11th February 2021. 

 

However, on 12th February 2021 office of  Divisional Commissioner issued a letter which converted process of registration of Society in Delhi from Offline to Online.
